Depending on the system, they can capture and transmit images and sound, display information in the wearer’s field of vision, or integrate AI functions.

The current debate about consumer smart glasses shows how sensitively people react to cameras and microphones in their immediate surroundings. It cannot be applied one-to-one to professional smart glasses, but it does raise important questions for companies as well, on data protection, employment law and acceptance.

What should companies bear in mind if they use or plan to introduce smart glasses? And what rules apply when employees bring their own consumer smart glasses to the workplace? We discussed this with Franziska Ladiges, a certified expert in IT Law with a focus on data protection, and Alexander Möller, certified expert in employment law, both of SKW Schwarz in Frankfurt.

Ms Ladiges, Mr Möller, the current discussion about consumer smart glasses is also creating a new sensitivity towards cameras and microphones in people’s immediate surroundings. How should this debate be viewed in relation to the professional use of smart glasses, and what distinguishes professional use from private use?

Franziska Ladiges: Above all, the discussion shows how sensitive people are to the possibility of being recorded without their knowledge. These concerns do not disappear at the factory gate. Employees, customers and business partners may also wonder what a pair of smart glasses is recording at any given moment, where that data is being transmitted and what happens to it afterwards. Companies should therefore take these concerns seriously in professional use as well.

That said, the current consumer debate cannot be applied one-to-one to professional smart glasses. In the workplace, smart glasses are introduced for defined purposes, such as remote assistance, training or digital work instructions. Companies can determine which functions are used, which data is processed and which technical and organisational safeguards apply.

Alexander Möller: Also from an employment law perspective, workplace use needs to be considered separately. Whether and how a company can introduce professional smart glasses depends, among other things, on whether an employee representative body is in place. Where there is no works council, professional use can generally be regulated under the employer’s right to give instructions. Where there is a works council, it must be involved in the introduction and use of the glasses accordingly.

Let us take an industrial company that wants to introduce professional smart glasses for remote assistance or training, for example. What should it clarify before deployment?

Franziska Ladiges: The starting point should always be a clear deployment concept: What are the smart glasses to be used for, which functions are actually needed for that purpose, and what data will be processed? The principles of purpose limitation and data minimisation should be taken into account from the outset. The purpose of use should be clearly defined, and processing should be limited to the data that is genuinely necessary for it.

From a data protection perspective, it makes a considerable difference whether images or audio are merely transmitted live or are also recorded and stored. Recordings require stronger safeguards and a more clearly established legal basis. Companies should therefore involve the data protection officer at an early stage and clarify the legal bases for the respective data processing activities.

Then there is the technical infrastructure. If platform or cloud providers are involved, it must be established who is the controller of the data, which service providers act as processors, and whether data may be transferred outside the European Economic Area. On that basis, the necessary security measures and rules for handling the data can be defined.

Alongside the legal requirements, employee acceptance also plays an important role. What can companies do to build trust in professionally deployed smart glasses?

Alexander Möller: The key is to bring employees on board early and to create transparency. Companies should explain why the smart glasses are being introduced and what purpose they serve, such as support, quality or safety. It is equally important to make clear what the glasses can do technically and what they expressly do not do.

The organisational framework should also be settled from the start. The relevant departments, such as HR, data protection and IT security, and the works council where applicable, should be involved at an early stage. Clear internal policies or operating agreements can also specify the purposes and situations for which the glasses may be used, who may access any recordings and what retention periods apply.

Franziska Ladiges: Trust can also be supported technically, through privacy by design. This means considering data protection when selecting and configuring the systems, and providing for privacy-friendly settings wherever possible. Practical training also helps, conveying not only how to operate the glasses but also how to handle data responsibly.

When smart glasses are then used in day-to-day work, various people may be affected: the employees wearing the glasses, as well as colleagues, customers or others in their field of vision. Which protective measures are particularly important in practice?

Franziska Ladiges: First of all, clear limits on use are important. Companies can specify, for example, the areas in which smart glasses may be used and which zones are excluded.

A great deal can also be done technically. Camera and microphone functions can be restricted or activated only when needed. Rather than recording continuously, recording should take place only when it is necessary for the specific use case. Where technically possible, people in the field of vision can also be blurred automatically.

Another important point is transparency. It should be as clear as possible to people nearby when a recording or transmission is active, for example through a clearly visible LED indicator on the glasses signalling that recording is in progress, or through some other unambiguous notice.

So far we have talked about professionally deployed smart glasses. What applies to consumer smart glasses in the workplace, for example when employees bring their own Ray-Ban Meta Meta into the office or onto company premises?

Alexander Möller: Clear rules are advisable here. Unlike professionally introduced smart glasses, a company generally cannot control the functions of private devices. At the same time, it must protect its employees, personal data and confidential company information.

Companies should therefore establish, as a matter of principle, whether and to what extent private consumer smart glasses are permitted in the workplace. In safety-critical or particularly confidential areas, a ban may make sense; in less sensitive areas, use without the camera and microphone functions may be permitted where appropriate.

Communication is important here too. Employees should understand why such rules exist: the aim is not a blanket ban on private technology, but the protection of other employees and of personal and confidential company data.

Professional smart glasses are also increasingly integrating AI functions, for example, for object recognition or to support certain work processes. What additional requirements can arise from this?

Franziska Ladiges: In that case, the EU AI Act adds a further regulatory framework alongside data protection. What matters is not simply that AI is used, but which AI function is actually deployed and what purpose it serves. Different requirements may apply depending on the application.

Certain AI applications that analyse or evaluate employees are particularly sensitive. For example, emotion recognition in the workplace, or assessments based on sensitive characteristics, may be prohibited under the AI Act or subject to special requirements. For high-risk AI, requirements on risk management, transparency, human oversight and documentation, among others, may become relevant.

Data protection law continues to apply in parallel. Where sensitive data such as health data or biometric data is processed in particular, the requirements for the legal basis, transparency and safeguards become more stringent. Companies should therefore not only ask whether professional smart glasses “can do AI”, but also examine carefully, when selecting and designing AI functions, which data is processed and what purpose the function serves.

Many companies want to deploy professional smart glasses at several European sites. What can be regulated uniformly across Europe, and where are national solutions needed?

Franziska Ladiges: The GDPR creates a common data protection framework within the EU. Core principles such as purpose limitation, data minimisation and transparency can therefore form the basis of a Europe-wide concept.

Alexander Möller: At the same time, there are national differences, particularly in employee data protection, co-determination rights and employment law. Which employee representative bodies must be involved in the introduction, or what additional requirements apply to the processing of employee data, can vary from country to country.

For a Europe-wide roll-out, it therefore makes sense to develop a uniform basic concept based on the GDPR and then adapt it to the relevant national requirements. Companies do not have to start from scratch in every country, but they should examine the local particularities of employment law and co-determination at an early stage.

Finally, what five recommendations would you give to companies wishing to introduce professional smart glasses?

Franziska Ladiges: First, a company should develop a clear deployment concept, including a risk analysis: What problem is the technology meant to solve, which functions are needed and what data will be processed?

Second, privacy by design should be part of the technical implementation from the outset. Data protection should not be added as an afterthought.

Alexander Möller: Third, the legal framework must be set up properly. This includes involving employee representative bodies where co-determination rights exist.

Fourth, transparency and training are needed. Employees should understand what the smart glasses are being used for, what they can do and what rules govern their use.

And fifth, we recommend starting with pilot projects. This allows technical, organisational and legal questions to be clarified first within a limited scope, and experience to be gained, before the technology is rolled out more widely.

About SKW Schwarz

SKW Schwarz is a full-service law firm with offices in Berlin, Frankfurt am Main and Munich, and a particular focus on innovation and digitalisation.
